1. Overview

ChromaPacks is operated by Bobyk Media Inc. ("we," "us," or "our"). Throughout the Site, the terms "we," "us," and "our" refer to Bobyk Media Inc. We offer this website, including all information, tools, and products available from it, to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting the Site or purchasing any product from us, you agree to be bound by these Terms of Service ("Terms"), including any additional terms and policies referenced herein. If you do not agree to these Terms, you may not access the Site or purchase our products.

Please also review our Privacy Policy and Refund Policy, which govern your use of the Site and form part of these Terms.

2. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your province, state, or territory of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this Site.

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of our products, violate any laws in your jurisdiction, including copyright laws.

3. Products and delivery

All products sold through the Site are digital wallpaper files ("Products"). Products are delivered electronically. Upon successful payment, you will receive access to download your Products via a download link, email delivery, or account access. No physical goods are shipped.

Each product page lists the resolutions, aspect ratios, and number of wallpapers included in that pack. You are responsible for downloading and storing your Products after purchase. While we make reasonable efforts to keep download links active, we do not guarantee indefinite access, and we recommend you back up your files.

We reserve the right to modify, discontinue, or limit the availability of any Product at any time without notice.

4. Licence

Upon purchase, you are granted a non-exclusive, non-transferable, perpetual licence to use the Products for personal, non-commercial purposes, subject to the terms below. You are purchasing a licence to use the Products — you are not purchasing ownership of the Products or the copyright in the underlying photographs.

4.1 What you may do

Download and set the Products as wallpapers or backgrounds on devices you personally own or control, including phones, tablets, computers, and displays.
Keep personal backup copies of the files for your own use.
Use the Products as backgrounds in personal, non-commercial contexts, such as personal social media posts or non-commercial presentations.

4.2 What you may not do

Resell, sublicense, rent, lease, lend, or otherwise redistribute the Products, whether modified or unmodified, and whether for payment or free of charge.
Share the Product files with any third party, including friends, family, or colleagues, unless they have purchased their own licence.
Upload the Products to any wallpaper site, file-sharing service, torrent network, public repository, stock image library, NFT platform, or cloud storage location accessible to others.
Include the Products in any app, theme, template, website, product, or bundle you offer for sale or distribute free of charge.
Print the Products for sale, or reproduce them on any physical merchandise offered for sale.
Use the Products in any commercial, promotional, advertising, or branded context without a commercial licence from us.
Edit, crop, filter, or otherwise modify the Products and present the result as your own original work.
Claim authorship of the Products or represent the photographs as your own.
Train, fine-tune, or otherwise incorporate the Products into any machine learning model, dataset, or generative AI system.
Use the Products in any way that is unlawful, defamatory, hateful, or that infringes the rights of others.

4.3 Commercial licensing

The standard licence covers personal use only. If you wish to use a Product in a commercial context — including in advertising, in a client project, on merchandise, within an app or software product, or as part of a brand's visual identity — please contact us to arrange a commercial licence. Commercial use without such a licence is a breach of these Terms.

4.4 Termination of licence

We may terminate your licence without notice or refund if you breach any term of this Section 4. Upon termination, you must delete all copies of the Products in your possession.

5. Pricing and payment

All prices are listed in the currency displayed at checkout and are subject to change without notice. We reserve the right to correct any pricing errors, including after an order has been submitted, and to cancel affected orders with a full refund.

Payment is processed by third-party payment providers. We do not store your full payment card details. By submitting payment information, you represent that you are authorized to use the payment method provided.

You are responsible for any applicable taxes, duties, or fees imposed by your jurisdiction.

6. Refunds

Because our Products are digital files delivered immediately upon purchase, all sales are final and non-refundable, subject to the limited exceptions set out in our Refund Policy. Please read the Refund Policy before purchasing.

7. Device compatibility and display

Each product page lists the resolutions and aspect ratios included in the pack. It is your responsibility to confirm that a Product suits your device or display before purchasing. Wallpapers are supplied at fixed dimensions and may crop, scale, or letterbox on devices whose screens fall outside the listed sizes.

Colour, contrast, and brightness will vary between displays depending on panel type, calibration, colour profile, and operating system settings. Preview images shown on the Site are accurate representations of the files included, but we do not guarantee that a Product will appear identical on your particular screen.

8. Intellectual property

All Products are original photographic works created by us. All content on the Site — including the Products, preview images, portfolio work, text, graphics, logos, and page layout — is the property of Bobyk Media Inc. and is protected by Canadian and international copyright law.

Copyright in the Products is retained by Bobyk Media Inc. at all times. Purchase of a Product grants the licence described in Section 4 and no other rights. You may not reproduce, distribute, publicly display, or create derivative works from any Site content beyond the scope of that licence without our prior written permission.

9. Accuracy of information

We are not responsible if information made available on this Site is not accurate, complete, or current. The material on this Site is provided for general information only and should not be relied upon as the sole basis for making decisions.

We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information. You agree that it is your responsibility to monitor changes to our Site.

10. Prohibited uses

In addition to the restrictions set out in Section 4, you are prohibited from using the Site or its content: for any unlawful purpose; to solicit others to perform unlawful acts; to violate any regulations, rules, or laws; to infringe upon our intellectual property rights or those of others; to harass, abuse, defame, or discriminate; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect or track the personal information of others; to spam, phish, or scrape; or to interfere with the security features of the Site.

We reserve the right to terminate your use of the Site for violating any prohibited use.

11. Disclaimer of warranties

The Products and the Site are provided "as is" and "as available" without any representation, warranty, or condition of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, durability, title, or non-infringement.

We do not warrant that your use of the Site will be uninterrupted, timely, secure, or error-free, or that the Products will meet your expectations.

12. Limitation of liability

To the maximum extent permitted by law, in no case shall Bobyk Media Inc., its directors, officers, employees, or affiliates be liable for any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of the Site or any Product, including without limitation lost profits, lost revenue, lost data, or damage to any device.

Where liability cannot be excluded, our total aggregate liability to you shall not exceed the amount you paid for the Product giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bobyk Media Inc. and its directors, officers, employees, and affiliates from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party.

14. Third-party links

The Site may contain links to third-party websites or resources that are not owned or controlled by us. We are not responsible for the content, accuracy, or practices of third-party sites, and inclusion of a link does not imply endorsement. Any dealings with third parties are solely between you and that third party.

15. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed without affecting the validity of the remaining provisions.

16. Changes to these Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates to the Site. It is your responsibility to check this page periodically. Your continued use of the Site or purchase of Products following the posting of changes constitutes acceptance of those changes.

17. Governing law

These Terms and any separate agreements whereby we provide you Products shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.

18. Entire agreement

These Terms, together with our Privacy Policy, Refund Policy, and any other policies posted on the Site, constitute the entire agreement between you and us and govern your use of the Site and Products, superseding any prior agreements or communications.
